These Terms and Conditions govern the provision of rubbish removal and waste collection services by Rubbish Removal Edgware to you as a customer. By making a booking, confirming a quotation, or permitting our team to carry out any work, you agree to be bound by these Terms and Conditions. Please read them carefully before using our services.
1. Definitions
In these Terms and Conditions, the following expressions have the meanings set out below:
Customer means the person, firm or company requesting rubbish removal or related services from Rubbish Removal Edgware.
Services means the rubbish removal, waste collection, bulky item disposal, clearance, loading, transportation and related services supplied by us.
Waste means any items, materials, rubbish or refuse that the Customer asks us to remove, subject to applicable waste regulations and any exclusions set out in these Terms and Conditions.
Contract means the agreement between us and the Customer for the provision of Services in accordance with these Terms and Conditions.
2. Scope of Services
Rubbish Removal Edgware provides rubbish removal and waste collection services for domestic, commercial and other premises. The exact scope of work, including the type and approximate volume of waste, access requirements and any special instructions, will be agreed at the time of booking or quotation.
We reserve the right to refuse to remove any items that we reasonably believe are hazardous, prohibited, illegal, improperly packaged, excessively heavy, or otherwise unsafe to handle or transport. This includes, without limitation, certain chemicals, asbestos, medical waste, gas bottles, explosives and other specialist waste streams.
The Customer is responsible for providing accurate information regarding the nature, quantity and location of the waste so that we can allocate the appropriate vehicle, equipment and manpower to carry out the Services.
3. Booking Process
Bookings for rubbish removal services may be made by telephone, email, online form or other agreed communication method. During the booking process, we will request details regarding the property, access, type of waste, estimated volume or weight, and preferred date and time for collection.
Any booking is subject to availability and is not confirmed until we have provided confirmation, which may be provided verbally, by email, text message or other written form. We may request photographs or additional details in order to assess the job accurately before confirming a booking or providing a quotation.
If, upon arrival, we find that the job significantly differs from the description given at the time of booking, we reserve the right to revise the estimated price, adjust the scope of work, or decline the job. In such circumstances, any call-out or minimum charge that has been communicated in advance may still apply.
4. Quotations and Pricing
Quotations are generally based on information supplied by the Customer, including the type and approximate volume of waste and site access conditions. All quotations are given in good faith but do not constitute a fixed price until we have inspected the waste on site, unless we state otherwise in writing.
Prices may be based on volume, weight, labour time, access difficulty, parking provisions, local disposal charges and any special handling requirements. We will explain our pricing structure to you at the quotation stage or on request.
If the actual volume or weight of waste, or the time required to complete the job, is greater than anticipated, we may adjust the price accordingly. We will always seek your approval before carrying out work that results in a higher charge than originally quoted.
5. Payments and Charges
Payment for rubbish removal and waste collection services is due on completion of the job, unless we have agreed alternative payment terms in advance. We may accept payment by cash, card, bank transfer or other method as notified to you at the time of booking.
For commercial or account customers, payment terms will be set out separately and may include specific invoicing arrangements and credit periods. We reserve the right to charge interest on overdue amounts at the statutory rate, as well as reasonable costs of recovery where applicable.
We may request a deposit or advance payment to secure a booking or to cover upfront costs such as disposal fees. Any such requirement will be communicated to you before confirming the booking.
6. Cancellations and Amendments
The Customer may cancel or amend a booking by providing reasonable notice prior to the scheduled arrival time. We request that cancellations or changes be communicated as early as possible to allow us to manage our schedule effectively.
We reserve the right to apply a cancellation charge where a booking is cancelled at short notice, particularly if our team has already been dispatched or if we have incurred costs. Any applicable cancellation charges will be communicated to you at the time of booking or in subsequent correspondence.
If we are unable to attend at the agreed time due to vehicle breakdown, staff illness, severe weather or other circumstances beyond our reasonable control, we will contact you as soon as possible to rearrange. In such cases, we will not be liable for any resulting losses, but no cancellation fee will be charged.
7. Access, Parking and Customer Obligations
The Customer must ensure that we have safe, reasonable and lawful access to the property and the waste to be collected at the agreed time. This includes ensuring that any gates, entrances, stairways and corridors are clear and that items to be removed are reasonably accessible.
The Customer is responsible for arranging any necessary parking permits, loading bay access or similar authorisations where required. If suitable parking is not available, we may not be able to carry out the Services, or additional time and costs may be incurred, which may be added to the final charge.
The Customer must ensure that waste is not contaminated with hazardous or prohibited materials and that any sharp or dangerous items are adequately contained to minimise risk of injury. Where the Customer is unsure whether an item can be collected, they should ask us in advance.
8. Waste Handling and Regulations
Rubbish Removal Edgware operates in accordance with applicable UK waste regulations. We aim to dispose of or recycle waste at licensed facilities and to minimise the amount of waste sent to landfill wherever reasonably possible.
The Customer confirms that they have authority to arrange disposal of the waste and that the waste is not stolen, unlawfully obtained or otherwise subject to any legal restriction. The Customer will indemnify us against any claims, fines or penalties arising from the unlawful nature of the waste provided by the Customer.
We will issue or retain any documentation that may be required by law for the transfer or disposal of waste. Where relevant, we may record details of the collection, including photographs, for compliance and proof of service.
9. Items We Cannot Remove
Certain types of waste cannot be collected as part of a standard rubbish removal service due to legal, safety or licensing restrictions. These may include, but are not limited to, asbestos, clinical or medical waste, certain chemicals and solvents, oil tanks, gas cylinders, explosives, radioactive materials and other specialist waste streams.
If we discover such items mixed with general waste, we may refuse to remove them and, in some cases, may decline the entire job where the presence of such items poses a risk. Any additional costs incurred as a result of dealing with prohibited or hazardous items may be charged to the Customer.
10. Liability and Limitations
We will exercise reasonable care and skill in the provision of our rubbish removal and waste collection services. However, our liability to the Customer is limited as set out in this clause.
We will not be liable for loss or damage arising from inaccurate information provided by the Customer, lack of access, unsafe site conditions, or the presence of hazardous items not disclosed in advance. The Customer is responsible for removing or securing any personal or valuable items before our team begins work.
We shall not be liable for any indirect, consequential or economic loss, including loss of profit, loss of business, or loss of opportunity, arising out of or in connection with the Services. Our total liability for any direct loss or damage shall, to the fullest extent permitted by law, be limited to the price paid or payable for the specific job in question.
Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited.
11. Damage to Property
Our teams will take reasonable care when carrying out removals and handling waste on your premises. The Customer must notify us of any fragile surfaces, fixtures, fittings or structures that may be particularly vulnerable to damage.
If damage occurs that is directly and solely caused by our negligence, you must notify us in writing as soon as reasonably practicable and in any event within seven days of the completion of the job. We may request photographs, access for inspection, or other information to assess the claim.
Our liability for any proven damage will be subject to the limitations described in these Terms and Conditions and may, at our option, be discharged by repairing the damage, arranging for repair, or paying fair and reasonable compensation up to the capped liability amount.
12. Customer Responsibility for Misidentified Items
The Customer is responsible for clearly identifying which items are to be removed and which are to be kept. Our team will act on the instructions given at the time of the job and will not be liable for the removal of items that were not clearly identified as items to be retained.
To avoid misunderstandings, the Customer should separate items to be removed from those to be retained wherever possible and give clear verbal instructions to our staff on arrival.
13. Time Estimates and Delays
Any time or date given for arrival or completion of the Services is an estimate only. While we make reasonable efforts to arrive within the agreed time window, delays can occur due to traffic, weather, previous jobs or other circumstances beyond our direct control.
If we anticipate a significant delay, we will contact the Customer using the details provided at the time of booking to provide an updated estimate. We shall not be liable for any loss, costs or expenses incurred by the Customer as a result of such delays.
14. Complaints
If you are dissatisfied with any aspect of our rubbish removal or waste collection service, you should notify us as soon as possible so that we have an opportunity to resolve the issue. Complaints should be made in writing where practical, providing details of the job, date, address and nature of the concern.
We will investigate any complaint in a fair and timely manner and may request further information or evidence. Where a complaint is upheld, we will seek to provide an appropriate remedy, which may include corrective work, a partial refund or another form of resolution, depending on the circumstances.
15. Data Protection and Privacy
We will handle any personal information provided by the Customer in connection with rubbish removal and waste services in accordance with applicable data protection laws. This may include storing contact details, job records and payment information for legitimate business purposes such as billing, customer service, compliance and record-keeping.
We will take reasonable steps to protect personal information from unauthorised access or disclosure and will not sell personal data to third parties. We may share necessary information with service providers and authorities where required for the performance of the Services or compliance with legal obligations.
16. Variation of Terms
We may update or amend these Terms and Conditions from time to time to reflect changes in law, regulation or our business practices. Any revised terms will be published or otherwise made available, and will apply to bookings made after the date of publication.
The version of the Terms and Conditions in force at the time of your booking or quotation will generally apply to that Contract, unless we have expressly agreed otherwise with you in writing.
17. Severability
If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful or unenforceable, such provision will be deemed modified to the minimum extent necessary to make it valid and enforceable. If such modification is not possible, the relevant provision will be deemed deleted. The remaining provisions shall continue in full force and effect.
18. Governing Law and Jurisdiction
These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter, shall be governed by and construed in accordance with the laws of England and Wales.
The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the provision of rubbish removal and waste collection services by Rubbish Removal Edgware.
19. Entire Agreement
These Terms and Conditions, together with any written quotation or confirmation provided by us, constitute the entire agreement between the parties in relation to the provision of rubbish removal and waste collection services and supersede any prior discussions, correspondence, understandings or agreements between us relating to the same subject matter.
By booking or using our rubbish removal services, you acknowledge that you have read, understood and agree to be bound by these Terms and Conditions.
